Charge: 4th Degree DWI

Result: Pled Guilty to Amended Charge of Careless Driving

Igbanugo Partners Int’l Law Firm v. Sabhari, et al., Minnesota Court of Appeals (September 2013)

Case: Appellant Igbanugo Partners appealed from a district court’s award of summary judgment to our client.

Result: The Court of Appeals affirmed the award of summary judgment, and the judgment of more then $15,000.00. Read Opinion here.

Charge: 2nd Degree DWI (Refusal)/3rd Degree DWI

Result: Pled Guilty to Amended Charge of 4th Degree DWI despite the fact that client had a prior DWI within the last 10 years.

State of Wisconsin v. Berends, Prescott Municipal Court (May 2013)

Charge: Possession of Marijuana/Drug Paraphernalia & Failure to Notify Officers of Accident

Result: Pled guilty to amended charge of Disorderly Conduct in a Motor Vehicle. Remaining charges dismissed.

State of Wisconsin v. Berends, Pierce County (April 2013)

Charge: Administrative Revocation of Driver’s License following suspected OWI.

Result: Administrative suspension rescinded because the blood draw was obtained without a search warrant.

In re the Welfare of L.M.O, Dakota County District Court (April 2013)

Charge: 2nd Degree Possession Methamphetamine; 5th Degree Possession Marijuana

Result: Charge of 2nd Degree Possession was Dismissed. Client received a Stay of Adjudication on 5th Degree charge.

State of Minnesota v. Mikkelson, Wright County District Court (April 2013)

Charge: 1st Degree Criminal Sexual Conduct

Result: Pled Guilty to lesser charge of 2nd Degree Criminal Sexual Conduct with a Stay of Adjudication. 1st Degree Criminal Sexual Conduct was dismissed.

Charge: 3rd Degree Driving While Impaired – Refusal (Gross Misdemeanor)

Result: Pled guilty to an Amended Charge of 4th Degree Driving While Impaired – Misdemeanor

State of Minnesota v. Chilpe-Rolando, Hennepin County District Court (February 2013)

Charge: 1st Degree Possession of Controlled Substance

Result: After being denied a motion challenging the search of client’s vehicle and facing a presumptive sentence of 98-months in prison, the Court granted motion for downward dispositional departure and sentenced client to serve 365 days in the Hennepin County Workhouse, followed by probation.

State of Minnesota v. Luke, Hennepin County District Court (February 2013)

Charge: 3rd Degree Driving While Impaired

Result: After much negotiating and after conducting an evidentiary hearing to challenge the legality of the stop of client’s vehicle, the State agreed to amend the charge to a 4th Degree Driving While Impaired, and give client credit for time already served with no further probation.

State of Minnesota v. Williams, Hennepin County District Court (January 2013)

Charge: 2nd Degree Criminal Sexual Conduct

Result: In the middle of selecting a jury, the State agreed to dismiss the charge of 2nd Degree Criminal Sexual Conduct, and allow the client to pled guilty to an added charge of False Imprisonment.

Pereira v. 2004 Dodge Durango, Hennepin County District Court (November 2012)
Charge: Attempted Vehicle Forfeiture following DWI
Result: Following a Court Trial, the district court determined that client was an innocent owner and ordered that the vehicle be immediately returned to his possession.

Charge: Terroristic Threats
Result: After threatening to amend the complaint to include a more serious charge of 2nd Degree Assault if the matter went to trial, on the morning of trial the State dismissed all charges.

Result: The Minnesota Supreme Court affirmed the Court of Appeals and ordered the vehicle returned to the client.
